Welcome to EverCart. These Terms & Conditions (“Terms”) govern your access to and use of the EverCart website, marketplace, services, features, and related platforms (collectively, the “Services”).

By accessing EverCart, creating an account, placing an order, or otherwise using our Services, you agree to these Terms and our Privacy Policy, Shipping & Returns Policy, and any other policies referenced on our website.

If you do not agree with these Terms, please do not use EverCart.

1. About EverCart

EverCart is an online marketplace that connects customers with products offered through EverCart, participating independent sellers, suppliers, and fulfillment partners.

EverCart is a brand of Wilkins Investments Enterprises (“WIE”).

Products available through EverCart may be sold or fulfilled by different participating sellers or third-party suppliers. As a result, product availability, processing times, shipping methods, return eligibility, and other product-specific conditions may vary.

Regardless of the fulfillment source, customers may contact EverCart Customer Care for assistance with purchases made through the EverCart marketplace.

2. Eligibility & Accounts

You must be legally capable of entering into a binding agreement to make purchases through EverCart. If you are under the age of majority in your jurisdiction, you may use EverCart only with the involvement and permission of a parent or legal guardian.

When creating an account, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Please notify EverCart immediately if you believe your account has been accessed or used without authorization.

EverCart reserves the right to suspend, restrict, or terminate accounts that violate these Terms, create security risks, engage in fraudulent activity, or misuse our Services.

3. Product Listings & Information

EverCart works to provide accurate product information; however, certain product descriptions, specifications, images, pricing, availability, and other information may be supplied by participating sellers or third-party suppliers.

Product images may be provided for illustrative purposes, and actual colors, packaging, appearance, or other characteristics may vary.

EverCart does not guarantee that every product description, photograph, price, inventory quantity, or other listing detail will always be error-free.

We reserve the right to correct errors, update product information, or remove listings when necessary.

4. Orders

Submitting an order does not necessarily mean that the order has been finally accepted.

EverCart may review, decline, limit, or cancel an order when reasonably necessary, including in cases involving:

Product or inventory errors;
Incorrect pricing;
Suspected fraud or unauthorized transactions;
Payment authorization issues;
Seller or supplier availability;
Shipping restrictions;
Violations of these Terms; or
Other circumstances preventing fulfillment.

If an order that has already been paid for is canceled, an appropriate refund will be issued to the original payment method.

5. Pricing & Payments

Prices are displayed in the currency identified on the website and may change without notice.

Applicable taxes, shipping charges, service fees, or other charges will be displayed during checkout when required.

EverCart may correct obvious pricing or listing errors. If an error materially affects an order that has already been submitted, we may contact you, cancel the affected item or order, and issue an appropriate refund.

Payments are processed through EverCart's authorized payment providers. By submitting payment information, you represent that you are authorized to use the selected payment method.

6. Marketplace Sellers

EverCart may allow approved independent businesses and third-party suppliers to offer products through our marketplace.

Participating sellers are responsible for complying with EverCart marketplace requirements, maintaining accurate product information, fulfilling applicable orders, providing valid shipment information, and cooperating with EverCart Customer Care when resolving customer concerns.

EverCart may establish standards for sellers and may suspend or remove sellers or listings that fail to meet marketplace requirements.

Customers purchasing through EverCart should direct order-related concerns to EverCart Customer Care rather than independently attempting to resolve fulfillment issues with third-party suppliers unless instructed otherwise.

7. Shipping & Delivery

Products may be shipped from different fulfillment locations. An order containing multiple products may therefore arrive in separate packages and on different dates.

Shipping methods, costs, and estimated delivery periods may vary depending on the product, seller, destination, and carrier.

Delivery dates are estimates unless expressly stated otherwise.

EverCart is not responsible for delays outside its reasonable control, including carrier disruptions, severe weather, customs processing, natural disasters, or other unforeseen circumstances.

8. Returns, Refunds & Replacements

Eligible merchandise may generally be returned within 14 days of delivery, unless different terms or exclusions are clearly disclosed for a particular product.

Returned merchandise must generally be unused, unworn, undamaged, and in its original condition and packaging.

Certain merchandise may not qualify for standard returns, including products designated as final sale and certain personalized, perishable, hygienic, intimate, digital, or opened personal-care products.

If an item arrives damaged, defective, incorrect, or materially different from its listing, customers should contact EverCart Customer Care promptly.

Because products may be fulfilled by different sellers or suppliers, customers should not send merchandise to a return address without first receiving return instructions from EverCart.

Refunds, replacements, and return requests are subject to the complete EverCart Shipping & Returns Policy and applicable law.

9. Promotions, Discounts & Gift Offers

EverCart may periodically offer promotional codes, discounts, sales, credits, or other special offers.

Promotions may be subject to additional terms, expiration dates, product restrictions, minimum purchase requirements, or availability limitations.

Unless otherwise stated, promotions have no cash value and may not be combined with other offers.

EverCart may modify or discontinue promotions as permitted by law.

10. Reviews & User Content

EverCart may allow customers to submit reviews, photographs, comments, questions, or other content.

By submitting content to EverCart, you represent that you have the right to submit it and that the content does not violate another person's rights or applicable law.

You grant EverCart a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute submitted content in connection with operating, promoting, and improving EverCart and its Services, subject to applicable law.

EverCart may moderate or remove content that is fraudulent, misleading, abusive, unlawful, inappropriate, or unrelated to the product or service being reviewed.

11. Prohibited Use

You may not use EverCart to engage in unlawful, fraudulent, abusive, or harmful conduct.

This includes attempting to compromise the security of the website, accessing another customer's account without authorization, submitting fraudulent payment information, manipulating reviews, abusing promotions or refund processes, scraping or copying protected website content without authorization, introducing malicious software, or interfering with the operation of EverCart.

EverCart may restrict or terminate access when misuse is reasonably suspected.

12. Intellectual Property

The EverCart name, logos, branding, website design, graphics, original content, and other EverCart-owned materials are protected by applicable intellectual property laws.

Unless expressly authorized, EverCart-owned materials may not be copied, reproduced, modified, distributed, sold, or commercially exploited.

Certain product names, trademarks, photographs, and other materials appearing on EverCart may belong to participating sellers, manufacturers, suppliers, or other third parties and remain the property of their respective owners.

13. Third-Party Services

EverCart may rely on third-party providers for services including payment processing, shipping, fulfillment, marketplace technology, analytics, communications, and other functionality.

The availability or performance of third-party services may occasionally affect features of EverCart.

Links to external websites or services do not necessarily constitute EverCart's endorsement of those third parties.

14. Privacy

Your use of EverCart is also governed by our Privacy Policy, which explains how personal information is collected, used, shared, and protected.

By using EverCart, you acknowledge the practices described in the Privacy Policy.

15. Disclaimer of Warranties

To the extent permitted by applicable law, EverCart and its Services are provided on an “as available” basis.

EverCart does not guarantee that the website will always operate without interruption, delay, or error or that every third-party seller, supplier, carrier, or service provider will perform without disruption.

Nothing in these Terms limits rights or warranties that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, EverCart and Wilkins Investments Enterprises will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EverCart, Wilkins Investments Enterprises, and their respective officers, employees, representatives, and affiliates from claims, losses, liabilities, or expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person's rights.

18. Suspension & Termination

EverCart may restrict, suspend, or terminate access to the Services when reasonably necessary to protect customers, sellers, EverCart, or the security and integrity of the marketplace.

Termination does not eliminate obligations arising from transactions or conduct that occurred before termination.

19. Changes to These Terms

EverCart may update these Terms periodically to reflect changes to our marketplace, policies, technology, business operations, or legal requirements.

The updated Terms will be posted with a revised “Last Updated” date.

Where required by law, additional notice or consent will be provided.

20. Governing Law

These Terms are governed by the laws of the jurisdiction identified by EverCart, without regard to applicable conflict-of-law principles.
